1. Introduction and definitions
These Terms and Conditions (the "Terms") govern the use of the website movisalento.it (the "Site") and the intermediation services offered by Movi Salento ("Movi").
For the purposes of these Terms:
- "User" or "Passenger": any person who uses the Site to request a transfer service.
- "Driver" or "Partner": any NCC (chauffeur-driven hire) driver who collaborates with Movi to provide transport services.
- "Service": the chauffeur-driven transport service provided by the Driver to the Passenger.
2. Nature of the service — Intermediation
Movi acts exclusively as an intermediation service between Passengers and NCC Drivers. Movi is not a carrier, does not provide transport services and does not hold NCC licences.
Movi merely facilitates contact between Passengers who need a transfer and independent NCC Drivers who operate with their own licence, vehicles and insurance.
The transport contract is entered into directly between the Passenger and the Driver. Movi is not a party to that contract.
3. Liability
3.1 Limitation of Movi's liability
Movi is not liable for:
- The quality, safety or punctuality of the transport service provided by the Drivers
- Any damage to persons, luggage or property occurring during the transport service
- Conduct, actions or omissions of the Drivers during the performance of the service
- The accuracy and currency of the information provided by the Drivers
- Any disputes between Passenger and Driver relating to the transport service or payment
- Delays, cancellations or unavailability of the service
3.2 Driver's responsibility
Each Partner Driver is an independent professional, holder of a valid NCC licence, and operates under their own exclusive responsibility. The Driver must hold a valid and compliant NCC licence, have a suitable, insured vehicle compliant with applicable regulations, hold adequate professional third-party liability insurance for the transport of persons, and comply with the Highway Code and all regulations applicable to the NCC service.
3.3 Passenger's responsibility
The Passenger must provide accurate information at the time of the request, arrive punctually at the agreed meeting point and behave respectfully.
4. Prices and payments
The prices shown on the Site are indicative and subject to change based on factors such as time of service, number of passengers, amount of luggage and specific route. The final price is communicated to the Passenger before the service is confirmed.
Payment is made directly between Passenger and Driver at the end of the service. Movi does not handle nor is it responsible for payments between the parties.
5. Bookings and cancellations
Bookings are handled via WhatsApp or through the Site. A booking is considered confirmed only after explicit communication from Movi.
In case of cancellation, the Passenger must give reasonable notice. Any cancellation penalties are set directly by the Driver.
6. Driver selection
Movi requires Partner Drivers to hold a valid NCC licence and to operate with suitable, insured vehicles. However, Movi does not carry out independent checks on the validity of licences, the condition of vehicles or the insurance cover of the Drivers.
7. Intellectual property
All content of the Site (text, graphics, logos, images) is owned by Movi Salento or used under licence. Reproduction without authorisation is prohibited.
8. Privacy and data processing
Personal data collected through the Site and the WhatsApp service is processed in accordance with Regulation (EU) 2016/679 (GDPR) and applicable Italian law.
9. Use through the Movi app
This section supplements the Terms with the specific conditions of the Movi mobile app. The following remain unchanged: the classification as an intermediation service (Movi is not a carrier and does not perform the transport; the transport contract is concluded between passenger and driver), the limitation of liability, the Italian law and the jurisdiction already indicated.
9.1 Free beta phase
In the app, Movi is currently in a free beta phase: it applies no commission and does not handle payments. The fare is agreed between passenger and driver and paid in cash directly to the driver. Movi reserves the right to introduce in the future, with prior notice and an update to these Terms, commissions and/or electronic payment methods.
9.2 Account and age
To register and use the app as the account holder you must be at least 18 years old and have full legal capacity. By registering you declare and warrant that you are at least 18 years old; an untrue declaration or data constitutes a breach of these Termsand makes you liable for the resulting consequences (see "Indemnity"). The 18-year requirement concerns the account holder and the person making the booking: minors may travel as passengers when the booking is made by an adult who takes responsibility for them.
9.3 How it works
The passenger posts a ride request (route, date/time, passengers, optional indicative budget); eligible drivers send offers with a price; the passenger chooses an offer and the ride is confirmed between the parties. Notification, navigation and contact features facilitate the meeting; the other party's phone number is made available only during the pickup phase, for coordinating the ride.
9.4 Driver obligations
Drivers declare and warrant that they hold a valid NCC licence and comply with applicable regulations, and that they will keep it valid throughout the period of use. Drivers must not knowingly transport unaccompanied minors: at pickup, acting reasonably, the driver refuses the ride if the passenger is manifestly a minor and not accompanied by an adult.
9.5 Cancellations, no-shows and reviews
Passenger and driver may cancel the ride through the relevant app features; the driver may report the passenger's no-show. As rides are agreed directly between the parties, any financial consequences of cancellations or no-shows relate to the relationship between passenger and driver. Passengers and drivers may leave ratings based on the actual experience of the ride; Movi may remove false, offensive, discriminatory or otherwise unlawful content.
9.6 Indemnity
You agree to indemnify and hold harmless Movi and the Data Controller from any claim, damage, cost or expense (including reasonable legal fees) arising from: (i) an untrue declaration by you, including one relating to age or possession of the requirements (e.g. NCC licence); (ii) your breach of these Terms or of the law; (iii) your use of the service or your conduct towards the other party of the ride.
9.7 Platform "as is"
The app is provided "as is" and "as available". Movi does not guarantee continuity, the absence of errors or interruptions, nor the availability of drivers for a specific request. The exclusions and limitations of liability already set out in these Terms remain in force, to the extent permitted by law.
10. Changes to the Terms
Movi reserves the right to amend these Terms at any time. Changes will be published on the Site and take effect from the date of publication.
11. Governing law and jurisdiction
These Terms are governed by Italian law. For any dispute arising from the use of the Site or the intermediation services, the competent court is that of Lecce, subject to the consumer's forum where applicable.
